§ 01 Introduction
By accessing or using Virtual Performance Tool (virtualperformancetool.com) you agree to these Terms. They form a legally binding agreement between you and Virtual Performance Tool SRL, a company incorporated under Belgian law. Contact: info@virtualperformancetool.com.
§ 02 Services
VPT is a subscription-based aviation performance calculation tool intended exclusively for entertainment and educational purposes within flight simulation environments (Microsoft Flight Simulator, Prepar3D, X-Plane).
VPT is not approved, certified, or suitable for real-world aviation operations of any kind. It must not be used for actual flight planning, dispatch, or any operational purpose in real aircraft. Misuse in real-world aviation is entirely at the user's own risk and liability.
§ 03 Free Demo — Evaluate Before You Subscribe
VPT provides a free "VPT Global Pro" demo subscription — no payment required — granting full access to all performance calculation features, all aircraft profiles, and 15 representative airports. The entire airport database is publicly visible at all times on the airport intelligence map, before any account or payment is required.
The demo exists so you can verify airport availability, aircraft coverage, and every feature before paying. By subscribing after having had access to the demo, you confirm you had a full and meaningful opportunity to evaluate whether VPT meets your requirements.
§ 04 User Obligations
As a user you agree to: (a) provide a valid and reachable email address; (b) use VPT solely for personal, non-commercial flight simulation; (c) never use VPT for real-world aviation purposes; (d) keep your credentials secure and not share your account (see §7); (e) use the free demo to evaluate the service before subscribing.
§ 05 Prohibited Activities
Users are expressly prohibited from: using VPT for any real-world aviation purpose; reverse-engineering, decompiling, or otherwise attempting to extract source code or algorithms; scraping airport, aircraft, or performance data by automated means; building third-party tools that replicate VPT functionality using its data; accessing the VPT API beyond normal application use; commercially reselling, sublicensing, or distributing access to more than one other person; and circumventing subscription checks or security measures.
§ 06 Intellectual Property
All content, software, algorithms, calculations, data compilations, and materials are the exclusive intellectual property of Virtual Performance Tool SRL. Without prior written consent you may not reproduce, distribute, sell, or create derivative works from any VPT content, output, or data structure.
§ 07 Account and Access
7.1 — Account use and shared cockpit
A VPT account is personal — it is linked to one SimBrief profile and one set of preferences. It can be used across multiple devices simultaneously.
Shared cockpit use is permitted. Sharing your account with one flying partner in a shared cockpit context (captain / first officer flying together) is acceptable. The calculation allowance is, however, calibrated for one person's normal usage. If shared use regularly exhausts your monthly quota, both users should subscribe individually.
7.2 — Calculation limits
All subscriptions include a rolling 30-day calculation allowance — see the pricing page for current figures by plan. These limits are set generously: the average subscriber uses well under 20% of their monthly allowance. Calculations performed on the 16 free demo airports never count toward the limit.
7.3 — Prohibited sharing
The following are prohibited and may result in account suspension or permanent termination without refund:
- Distributing credentials to more than one other person
- Reselling, sublicensing, or monetising access to your account
- Sharing the account with a group or with people you do not personally fly with
- Using the account in any organised way that lets multiple unrelated users benefit from a single subscription
VPT also reserves the right to suspend or permanently terminate any account that engages in any prohibited activity (§5), abuses the refund policy (§10.3), or provided false registration information. Termination for cause does not entitle the user to any refund of fees paid.
§ 08 Third-Party Links
VPT may link to third-party websites. We are not responsible for their content, privacy policies, or practices. Inclusion of a link does not imply endorsement.
§ 09 Limitation of Liability
To the fullest extent permitted by Belgian law, Virtual Performance Tool SRL is not liable for: any loss from use of VPT in real-world aviation; errors attributable to third-party data providers; service unavailability due to maintenance, infrastructure failure, or force majeure; flight simulator platform failures; or any indirect, incidental, consequential, or punitive damages. VPT's total aggregate liability shall not exceed the subscription fees you paid in the 12 months preceding the event.
§ 10 Refunds, Cancellations and the Airport Database
10.1 — Pre-Purchase Evaluation
The free demo (§3) and the public airport intelligence map give you complete visibility into VPT's features and airport coverage before you pay. By subscribing you confirm you had a full opportunity to evaluate the service.
10.2 — EU Statutory Right of Withdrawal
Under Article 16(m) of EU Directive 2011/83/EU, the 14-day right of withdrawal does not apply to digital services where performance begins with the consumer's prior express consent and acknowledgment that the right of withdrawal is thereby forfeited. When you complete your subscription purchase, you expressly request that VPT begin the digital service immediately and you acknowledge that you waive any statutory right of withdrawal. This consent is collected at the point of payment.
10.3 — Goodwill Refund Window
Notwithstanding §10.2, VPT may, at its sole and absolute discretion, grant a refund within 7 calendar days of a user's very first subscription payment. This is a voluntary goodwill gesture — it is not a legal obligation or a right of any kind.
- The payment is not the user's first subscription payment; renewals are never eligible.
- Usage data reasonably indicates the service was accessed and used substantively, beyond evaluation.
- The user or any linked account has previously received a refund from VPT.
- The stated reason is the absence of a specific airport from the database (see §10.4).
Requests must be submitted to info@virtualperformancetool.com within the 7-day window. Approved refunds are processed within 14 business days via the original payment method.
10.4 — Airport Database: A Disclosed Known Limitation
VPT's airport database is actively maintained and continuously growing, but it does not include every airport in the world and does not represent itself as doing so. This is a known and publicly disclosed product characteristic, not a software defect, a service interruption, or a breach of contract. Before any payment is required, the full list of supported airports is accessible via the free demo and the public airport map.
Refund requests based on the non-availability of a specific airport will not be granted. Users have full pre-purchase access to verify airport coverage. VPT will consider airport addition requests at its sole discretion — such additions are not guaranteed and do not affect these Terms.
§ 11 Availability of Service
VPT makes every reasonable effort to maintain service availability but does not guarantee uninterrupted access. In the event of an outage exceeding 12 consecutive hours, please contact info@virtualperformancetool.com to discuss a commercial gesture at VPT's sole discretion.
§ 12 Warranties and Disclaimers
The service is provided "as is" and "as available" without warranties of any kind, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement. VPT does not warrant that performance calculations are error-free or exhaustive.
§ 13 Governing Law and Dispute Resolution
These Terms are governed by the laws of Belgium. Any dispute shall be subject to the exclusive jurisdiction of the courts of Brussels, Belgium. EU consumers may also use the European Commission's Online Dispute Resolution platform: ec.europa.eu/consumers/odr.
§ 14 Changes to These Terms
VPT may update these Terms at any time. Changes are posted on this page with an updated effective date. Significant changes are notified via in-app or email notification. Continued use after posting constitutes acceptance of the revised Terms.
§ 15 Acceptance of Terms
By accessing or using VPT you accept these Terms in full. If you do not agree, please do not use the service.
